2 03.03.2011 Heard learned counsels for the petitioner and

the State.

The petitioner being the husband of the

informant is apprehending his arrest in a complaint

case in which cognizance has been taken under Section

498A of the Indian Penal Code and Section 4 of the

D.P. Act.

There are allegations of demand of dowry

and torture against the petitioner.

Learned counsel for the petitioner, on

instruction, submits that he is ready to keep the

complainant as wife with full dignity and honour.

It appears that earlier also the case was

lodged which got compromised.

Considering the aforesaid facts, let the above

named petitioner, be released on anticipatory bail, in

the event of his arrest or surrender before the learned

Court below within a period of 12 weeks from today,

on furnishing bail bond of Rs. 10,000/- (ten thousand)

with two sureties of the like amount each to the

satisfaction of the learned Chief Judicial Magistrate,

Vaishali at Hajipur in connection with Complaint Case

No. C1-1880 /2009, Tr. No. 3771/10, subject to the

conditions as laid down under Section 438(2) Cr.P.C.

Let the learned court below accept the bail

bond of the petitioner provisionally and issue notice to

the complainant and fix a date for appearance. The

provisional bail bond will be accepted finally in two

eventualities (i) when the matter is substantially

reconciled or (ii) reconciliation fails due to the laches

on the part of the complainant.
