2. 26. 03. 2011. Heard learned counsel for the petitioners and the State.

This two bail petitions have heard together and disposed

of by a common order.

The petitioners are apprehending their arrest in a case

registered under Sections 147, 148, 149, 341, 379 and 120B of the

Indian Penal Code.

There is allegation of theft of coal from the coal dump

and eleven persons have been named accused along with twenty

unknown persons.

Learned counsel for the petitioners submits that out of

said named eleven persons, some of the accused persons have been

granted bail by order dated 03.12.2010 in Cr. Misc. No. 39393 of

2010 and Cr. Misc. No. 36537 of 2010 and the case of the

petitioners are on same footing.

Having regard to the fact that some of the accused

persons on similarly situated case have been granted bail on

03.12.2010, let the above named petitioners be released on bail in

the event of arrest or surrender before the learned court below within

a period of four weeks from today in connection with Bhagalpur

Rail P.S. Case No. 42 of 2010 on furnishing bail bond of Rs.

10,000/- (Ten thousand) each with two sureties of the like amount

each to the satisfaction of the Railway Judicial Magistrate,

Bhagalpur, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
