APPEAL No. 2170 of 2009

1. Heard learned advocate Mr.Shalin Mehta for the appellant Insurance Co.

2. Considering the submissions, the appeal is admitted.

CIVIL
APPLICATION No.5656 of 2009

1. Rule
returnable on 1.7.2009.

2. Ad-interim
relief in terms of Para.4(A) on condition that applicant
appellant shall deposit the entire awarded amount together with cost
and interest with the claims Tribunal, on or before the returnable
date.

3. After
realizing the amount from the applicant Insurance Co., the claims
Tribunal concerned is directed to pay 30% amount to respondent
claimant Nathiben Chanabhai Parmar by account payee cheque in her
name and rest of the amount be invested in any nationalized bank in
the name of respondents claimants for a period of three years but,
FDR shall remain with the Nazar of the claims Tribunal and the
respondents claimants are entitled periodical interest upon said
FDRs till the appeal is finally decided by this Court. The said FDRs
shall be renewed periodically till the appeal is finally decided by
this Court.
