Heard Mr. D. P. Singh, learned counsel for the revisionist, learned AGA for
the State and perused the record.
Issue notice to respondent no. 2, who may file counter affidavit within four
weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List immediately after expiry of the aforesaid period.
By the next date of listing the operation of the impugned order dated
29.4.2010 passed by the Judicial Magistrate, Court No. 11, Mirzapur, in Case
No. 131 of 2009, Smt. Suman Devi and others Vs. Shiv Kumar, shall remain
stayed provided the revisionist pays all the due amount till August 2010
calculated at the rate as ordered by the trial court from the date of the order
i.e. 29.4.2010 by 31.8.2010 and continues to pay the same by 7th day of each
month from September 2010. The amount already paid by the revisionist u/s
24 of the Hindu Marriage Act, shall be adjusted.
The amount so deposited by the revisionist may be withdrawn by respondent
no. 2.
