                         J U D G M E N T

Petitioner’s mother has an account in the Pettah

Branch of the State Bank of Travancore, the Manager of

which is the first respondent. According to the petitioner,,

his mother intends to transfer amounts from her account at

the instigation of the second respondent, who is none other

than the sister of petitioner. Coming to know of the same,

petitioner made Ext.P2 representation to the first

respondent, requesting that he shall be informed of any

such transfer of amounts. Complaining that there has not

been any response to the representation, the writ petition

has been filed.

2. As rightly pointed out by the learned standing

counsel appearing for the first respondent, petitioner is a

third party and that he cannot in any manner challenge

the rights of the mother, the account holder, to deal with

her assets in the manner she deems it appropriate.

Therefore, petitioner has no legal right to insist that the

Bank should keep the petitioner informed of the

transactions of his mother.

In that view of the matter, this Court will not be

justified in directing the bank to comply with the

petitioner’s request contained in Ext.P2.

Writ petition fails and it is accordingly dismissed.
