petitioner. Counsel for the State is present.

This writ application was filed for

assailing the order of suspension dated

11.7.2002. Such order of suspension was

passed in contemplation of a departmental

proceeding and, therefore, if the

departmental proceeding against the

petitioners has not been concluded as yet,

the same must be concluded within a period of

six months from the date of

receipt/production of a copy of this order,

whereafter, a decision, with regard to the

period of suspension, would be taken in

accordance with Rule 97 of the Bihar Service

Code. If any order, however, as with regard

to the suspension, in question, has already

been passed, the authority will not be

required to pass any fresh order in this

regard.

With the aforementioned observation

and direction, this application is disposed

of.
