Argument is that irrigation charges can only be taken in
accordance with U.P. Irrigation Charges (State Canal
System) Rules, 1995 and in fact whatever respondents has
already taken that is in excess of the amount what the
petitioner can be required to pay.

In view of the aforesaid, this court is of the view that matter
needs disposal on getting response from the respondents.

All the respondents are represented by learned Standing
Counsel. He may file counter affidavit by the next date.

List this matter in the month of August, 2010.

Till the next date of listing pursuant to the citation dated
20.05.2010 no further amount will be recovered.
