Heard
learned counsel for the parties.

Considering
the averments made on oath by the applicants, who are legal heirs of
original petitioner of the Special Civil Application No.3318 of 2008
and perusing the death certificate dated 11.8.2008 of Jesangbhai
Nathabhai Makwana issued by the competent authority, prayer in terms
of para 5(B) is granted.

Accordingly,
this Civil Application is allowed. Cause title of the Special Civil
Application No.3318 of 2008 be amended and thereafter the Office is
directed to place it for hearing.
