Mr.E.E. Saiyed, learned counsel for the appellants and Mr.H.L. Jani,
learned Additional
Public Prosecutor for respondent-State.

Mr.Saiyed
has produced on record authority letter of the appellants, viz.
Dashrathbhai Keshavbhai Vankar and Jadiben Keshavbhai Vankar and
contended that the appellants have filed two appeals, i.e. Criminal
Appeal No.961 of 2000 and Criminal Appeal No.971 of 2000, against
the judgment and order dated 20th October, 2000 passed by
the learned 3rd Joint District Judge, Kheda at Nadiad.
The appellants also submitted in their letter that first they had
filed Criminal Appeal No.961 of 2000 and subsequently Criminal
Appeal No.971 of 2000 was filed. Therefore, the appellants seek
permission to withdraw the present appeal. Mr.Saiyed has contended
that the said authority letter is also sent to Mr.U.I. Vyas, learned
counsel for the appellants in the present appeal through RPAD as
well as Courier.

I
have perused the letter of the appellants as also receipt of RPAD
and courier. It appears that both the appeals, i.e. Criminal Appeal
No.961 of 2000 and Criminal Appeal No.971 of 2000, are filed against
the judgment and order dated 20th October, 2000 passed by
the learned 3rd Joint District Judge, Kheda at Nadiad.

Hence,
prayer as prayed for by the appellants, is granted. Present appeal
being Criminal Appeal No.971 of 2000 is hereby disposed of as
withdrawn. Record and Proceedings, if any, be sent back to the trial
Court concerned, forthwith.
