Background
1. The Applicant filed an RTI application dt.12.6.08 with the CPIO, NR, New
Delhi. He requested for information against 4 points including the following:
i) What is the reason for including only 4 names in the seniority list
circulated on 31.3.08 for promotion to Group B where the date of promotion
of all the 4 persons to Scale Rs.6500-10500 has been shown as 8.1.04.
ii) What was the basis adopted for including only 4 names in the eligibility
list circulated on 31.3.08 while the applicant and some others were exactly
similarly situated as those 4 persons as on 8.1.04.
The CPIO replied on 26.6.08 furnishing point wise information. Not satisfied
with the reply, the Applicant filed an appeal dt.4.7.08 with the Appellate
Authority reiterating her request for the information. The Appellate Authority
replied on 29.7.08 directing the CPIO to provide fresh comments received
from branch through letter dt.26.6.08 and inviting the Applicant to inspect the
relevant records on any working day. Aggrieved with the reply, the Applicant
filed a second appeal dt.25.8.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 2, 2009.
3. Mr. Ravindra Kumar, Dy. GM/Law cum CPIO, Mr. R.S. Rawat, APO/G and Mr.
Arun Saxena, SC/G represented the Public Authority.
4. The Applicant was present along with her representative Mr. A. P. Nagrath
during the hearing.
Decision
5. After hearing the submissions from both sides, the Commission directs the
CPIO to provide the copy of Railway Board’s letter based on which names
have been included in the eligibility list and also copy of the order regularizing
the service of all the four people in the seniority list, by 15th June, 2009.
6. The appeal is disposed off.
