Heard learned counsel for the petitioners and the learned

A.G.A. for the State-respondents.

Considering the facts and circumstances and the allegations

made in the impugned F.I.R. the writ petition is disposed of

with the direction that till the submission of report by the

Police under Section 173(2) Cr.P.C., the petitioners shall not

be arrested in N.C.R. No. 346 of 2009, under Sections 323 &

504 I.P.C. Police Station Jalalabad, District Shahjahanpur

subject to the condition that they present themselves before

the Investigating Officer whenever required and cooperate

with the investigation.
