In view of observations and directions made by the

learned Sessions Judge, particularly in Paragraph -5 of the

impugned order, the present petition for grant of anticipatory bail

seems to be completely misconceived.

In view of the compromise having been arrived at

between the parties, as has been claimed by the petitioner, let the

petitioner and his wife i.e. the complainant appear in the court

below together within a period of four weeks from today in

connection with Complaint case No.874 of 2007 pending in the

court of learned Chief Judicial Magistrate, Motihari, East

Champaran and seek regular bail. If the learned court below is
Patna High Court Cr.Misc. No.31450 of 2011 (2) dt.14-10-2011

satisfied that the matter has been compromised between the parties

and they are living together, then learned Magistrate will be

obliged to release the petitioner on bail on the same day.

With the aforesaid observations and directions,

application stands disposed of.

Let this order be communicated to the court below

through FAX at the cost of the petitioner.
