Facts
:-
The Commission has received a complaint through e-mail from Shri
Arghya Mishra of Mumbai, Maharashtra that his request under RTI Act, 2005
seeking information with regard to marks obtained by him in Combined Graduate
Level (Main) Examination, 2009 and cut-off marks fixed by the Commission,
submitted to Central Public Information Officer, Staff Selection Commission, New
Delhi has been responded to by advising him to apply afresh after declaration of
final result of the examination but the information sought has not been provided,
even though the application was duly submitted along with the requisite fee on
19.05.2008.
Admitting the complaint of Shri Mishra u/s 18(1)(e) of RTI Act, the
Commission served notice on CPIO, SSC, New Delhi on 04.10.2009 seeking
comments on the complaint. The appellate authority Shri Shiv Kumar Gandotra,
Deputy Secretary, SSC submitted his comments on 10.11.2009 endorsing a copy
also to complainant Shri Mishra. Shri Shiv Kumar Gandotra DS has informed the
Commission that in response to the request received from the complainant he
was already informed that the information could be provided to him only after
declaration of the final result of the said exam and as the final result has now
been declared in the month of Feburary/March 2009, the information as sought
for by the complainant, is being provided through thess comments. The appellate
authority has provided the information sought in his comments.
Decision

It is clear from the comments now submitted by the appellate authority
Shri Shiv Kumar Gandotra, DS, that the request of the complainant has been met
by the SSC and the information sought has now been provided to him. In
absence of any rebuttal from the complainant on comments submitted by the
appellate authority, it may be presumed that the information which has now been
supplied is in conformity with the information as asked for. In light of the above
the present complaint is hereby closed.
On the other hand complainant Shri Mishra is advised that the information
provided is in response to his original application. In view of this, should he have
found the response now provided by the SSC unsatisfactory he may approach
the appellate authority, Shri Shiv Kumar Gandotra Deputy Secretary SSC, New
Delhi in 1st appeal u/s 10(1) of the Act, and consequently if, not satisfied with the
information provided on his 1st appeal, complainant Shri Mishra will be free to
move a 2nd appeal before us as per Sec 19 (3).
Announced this twenty fourth day of December 2009. Notice of this
decision be given free of cost to the parties.
