This writ petition under Article 226 of the Constitution of India has been
preferred by the petitioner against the impugned recovery certificate on
account of non payment of electricity dues.
Sri Manoj Dwivedi appeared for U.P. Power Corporation Limited and submits
that petitioner has not paid any charges since long. Electricity Connection will
be restored only in case the petitioner deposits half of the amount.
Keeping in view the facts and circumstances, and concession given by the
learned counsel for respondent, the petitioner is permitted to pay entire dues
in three equal quarterly instalments. The first instalment shall fall due in the
second week of February 2010. As and when the petitioner deposits the first
instalment, the respondent shall restore the electricity connection. However,
in the event of default of payment, as stipulated above, it shall be open for the
respondents to proceed with the recovery proceedings in accordance with law.
Subject to above, the writ petition is disposed of finally.
