1. The appeal was heard on 8/7/2010, in absence of the appellant.
2. The CPIO stated that the desired information has been furnished and that
there is no denial of information. He stated that the desired information was not
readily available and, therefore, it had to be collected and compiled from other
offices located at distant places. This has caused some delay in providing the
information.
Decision:
3. As there is no denial of information and that the delay in providing
information was caused due to the fact that the information was not readily
available in CPIO’s office, there is no justification for initiating penalty
proceedings against the CPIO. The appellant’s plea for imposition of penalty is,
therefore, rejected.
