ORDER

Heard learned
advocate Mr.Maulik J. Shelat for the applicant. Stay of the impugned
award on condition that the Insurance Company shall deposit the
amount on or before 23rd August 2010. On that amount is
deposited, the Tribunal is directed to invest the amount in a Fixed
Deposit Account of any Nationalized Bank in the name of respondent
/claimants initially for a period of three years with
periodical renewals till the First Appeal is finally decided
by this Court. Though the amount is deposited in the name of the
respondent/ claimants, the Fixed Deposit Receipt shall remain with
the Nazir of the Claims Tribunal till the appeal is finally decided
by this Court.

The Tribunal is
also directed to pay the interest accruing on the fixed deposit to
the claimants every quarter on proper verification. In the event the
opponents- original claimants are aggrieved by this order, they can
approach this Court by filing a Civil application within three months
from the date of service. This Civil Application is disposed of
accordingly.
