ORAL ORDER

This
application, under Section 5 of the Limitation Act, is filed by the
applicants seeking condonation of delay of 76 days caused in filing
the above Appeal from Order against the order dated 28.02.2005 passed
by the learned Chamber Judge, City Civil Court, Ahmedabad.

Having
regard to the averments made in the application and considering the
submissions made by Mr. Gupta as well as Ms. Patel, learned advocate
and Ms. Amin for Mr. Vakhariya, learned advocate, it emerges that the
applicants have explained the delay and has also made out sufficient
cause for condonation of delay. Hence, the delay of 76 days caused in
filing the above Appeal from order is condoned. The application is
allowed in terms of para 5(B).

Rule
is made absolute to the aforesaid extent.
