                     W.P.(C) No.5240 of 2010
                  -------------------------------------------
Dated this the 17th day of February, 2010

                              JUDGMENT

The petitioner is a stage carriage operator conducting service

on the route Thalpacheri-Kasaragod with vehicle No.KL-13/J 5481.

According to the petitioner, his timings were fixed on 26.7.2005.

Subsequent to the settlement of his timings, a number of new

services have started operation on the route. Consequently, the

time gap available to the petitioner’s service has become

substantially reduced. As a result, it has become difficult for the

petitioner to conduct his services without clashes with the timings of

the other operators. The petitioner has therefore, moved the

respondent for a revision of his own timings. His complaint is that

no orders have been passed on his application till date.

In the above circumstances, this Writ Petition is disposed of

directing the respondent to consider the request of the petitioner for

variation of his own timings, as evidenced by Ext.P1 in accordance

with law, as expeditiously as possible and at any rate within a

period of two months from the date of receipt of a copy of this

judgment, after hearing the petitioner as well as other interested

persons.
