ORDER
Background
1. The RTI Application dated 19.5.2010 by the Applicant with the PIO, S.E Railway, Chakradarpur. He
wanted to know whether he is eligible to get dual charge allowance and also sought the Rly Board Guidelines
or order related to the same. Not receiving any reply from the PIO he filed his first appeal on 27.7.2010. The
Appellate Authority replied on 8.10.2010 stating that the Applicant has not specified about the information
sought by him and that instead has asked him whether he is eligible for dual charge allowance or not which is
not information as defined u/s2(f) of the RTI Act. Further the Applicant has asked for relevant documents or
Railway Board guidelines without giving any reference, letter number or date. This is basically a grievance
case for which the Applicant can approach the concerned authorities i.e. CMS and Sr.DPO. Being aggrieved
with this reply the Applicant filed his second appeal before the Commission requesting for the information.
Decision
2. During the hearing the Respondent submitted that a letter dated 20.8.2010 was
sent to the Appellant informing him that there is no post of Assistant Steward in the Rly Hospital,
Chakradharpur and that the Appellant was only given extra duties to perform in the hospital kitchen in addition
to his duties as the HC . According to the Respondent since there is no post of Assistant Steward no dual
charges can be paid. He also stated that a second reply was sent on 25.4.2011 once again clarifying the
position of the Public Authority to the Appellant while enclosing relevant rules for his (Appellant’s) benefit.
3. It is clear from the submission of the Respondent that the Appellant is not eligible for dual charge
allowance since there is no post of Asst. Steward in the Railway Hospital. The Commission holds that all the
available information has been provided to the Appellant and that there is nothing further that can be
authorized for disclosure.
4. The case is accordingly disposed of.
