By order dated 19.5.2009, this Court had directed the learned Standing
Counsel to produce the relevant record on the next date.

However, today Sri M.B. Singh leanred Standing Counsel submits that the
record is not available with him.

List on 23.2.2010. On the next date, learned Standing Counsel shall produce
the record as directed by this Court on 19.5.2009.

Sri Rajendra Singh Chauhan has filed his Power on behalf of opposite party
no.3. The same is taken on record.

In the meantime, if he so chooses , may file counter affidavit.
