02. 07-10-2010 Heard learned counsel for the three petitioners and learned

Additional Public Prosecutor for the State.

Petitioners are named accused in this case being parents-in-

law and married sister-in-law of deceased daughter of the informant,

who died within four years of her marriage, after being subjected to

torture for demand of dowry etc. However, the informant appears

taking U turn by filing a petition that deceased died of natural death

after treatment provided by her-in-laws and there was no otherwise

demand or intention.

If it is so and informant on appearing as a witness on due

identification supports factum of filing of the petition on 26.3.2010

and contends therein that her husband and son both appearing as

bailors of the petitioners, and in the event of their arrest/surrender

before the court below within four weeks of receipt of the copy of this

order, petitioners, namely, 1.Krishna Bhagat, 2.Batasia Devi and

3.Urmila Devi, are directed to be released on bail on furnishing bail

bond of Rs. 10,000/- (ten thousand only) each with two sureties of the

like amount each to the satisfaction of Chief Judicial Magistrate,

Gopalganj in connection with Kateya P.S. Case No. 202 of 2009,

subject to condition laid down under Section 438 (2) of the Criminal

Procedure Code with additional condition to petitioner no. 1, namely,

Krishna Bhagat to remain physically present before the court below

till disposal of the case, in case of failure on two consecutive dates,

the liberty shall be deemed to be cancelled.
