the present application.
The present crl. misc. bail application has been filed with the
prayer to enlarge the applicant on bail in Case Crime No.47
of 2009, under Section 363, 366 IPC, P.S. Niwari, District
Ghaziabad.
Heard learned AGA for the State and perused the record.
The first information report was lodged by Jitendra brother
of the prosecutrix Kumari Shashi. The prosecutrix is aged
about 15-16 years and she was student of class 8th. She was
enticed away by applicant on 8.12.2008 in which co-accused
Billu and Kishori has assisted him. Neither she has been
recovered as yet nor she was produced by the applicant
before the court or before the I.O. for recording statement.
Defence of the applicant is that he was falsely implicated in
the present case. In the present case as mentioned in the
application the applicant is in jail since12.3.2009.
Ld. AGA opposed the aforesaid prayer for bail on the ground
that there was no reason for false implication of applicant.
Since prosecutrix has not been recovered as yet hence
applicant is not entitled for bail.
In view of aforesaid facts, without expressing any opinion on
merit, it is not a fit case for bail. Accordingly, the application
for bail is rejected.
However, the trial court is expected to conclude the trial as
expeditiously as possible without unreasonable delay and
unnecessary adjournment.
