Heard learned counsel for the petitioner and the learned
counsel for the Central Government.

This writ petition raises a dispute which is within the
jurisdiction of Armed Forces Tribunal constituted under the
Armed Forces Tribunal Act, 2007.

Therefore, in view of Section 34 of the Armed Forces
Tribunal Act, 2007 and the decision of this Court in the case
of Devi Saran Mishra Vs. The Union of India (W.P. No.
6237/1990) decided on 25.02.2010, let the records of the
present writ petition be transmitted to the Armed Forces
Tribunal at Lucknow.
