1. This
application has been filed with the following prayers :

“(A) YOUR
LORDSHIPS be pleased to allow this Civil Application in the interest
of justice;

(B) YOUR
LORDSHIPS be pleased to fix the earliest date of hearing of Special
Civil Application No.24112 of 2007 or in alternate prepond the date
of final hearing of the Special Civil Application No.24112 of 2007 as
may be deem fit by this Hon’ble Court in the interest of justice and
equity;

(C) YOUR
LORDSHIPS be pleased to grant such other and further reliefs as
deemed fit in the interest of Justice and equity;”

2. Mr.Asit
B. Joshi, learned advocate for Mr.P.M.Dave, learned counsel for the
applicant (original petitioner) submits that Special Civil
Application No.24112/2007 has been fixed for final hearing on
2.8.2011. Though, the said date is not too far away, however, the
petitioner has been diagnosed to be suffering from Cancer, namely
“Squamous cell carcinoma, high grade”, therefore, the
interest of justice would be met if the date of hearing of the
petition is preponed, looking to the above facts.

3. Having
hearing the learned counsel for the applicant and in view of the
averments made in the application, and as the petitioner has been
diagnosed to be suffering from Cancer, the following order is passed
:

Special
Civil Application No.24112/2007 be listed for final hearing on
29.6.2011.

The
application is disposed of, as above.
