Heard learned counsel for the applicant and learned A.G.A. for the
State and perused the record.
Learned counsel for the applicant contended that the First
Information Report was lodged against the unknown persons.
Subsequently, in the statement of the tenant, name of the applicant
along with co-accused was disclosed. As per statement of witness,
deceased was seen taking liquor along with applicant and other co-
accused. Hence merely on the basis of last seen evidence and due
to suspicion, the applicant was implicated in the present case.
Though there is no direct evidence regarding involvement. Co-
accused Rajveer @ Raju was released on bail in pursuance of the
order passed by this Court in Criminal Misc. Bail Application No.
11607 of 2010 on 20.5.2010. There is no criminal history of the
applicant. However, he is in jail since 13.2.2010.
In this view of the matter, without expressing any opinion on
merits of the case, let the applicant namely, Sunil be released on
bail in Case Crime No. 52 of 2010, under section 302 I.P.C., P.S.
Sirsaganj, District Firozabad on his furnishing a personal bond
with two sureties each in the like amount to the satisfaction of the
Court concerned.
