Heard learned counsel for the applicant and learned AGA and perused the
record.

The learned counsel for the applicant submitted that none is named in the FIR
but on 18.06.2003, three persons were seen moving on the stolen motorcycle.
One of them namely Vikas Kumar Singh managed his escape from the scene
and could not be caught on the spot but the applicant and the co-accused
Kundan Singh were trapped. The motorcycle was being driven by the
applicant the other accused were on the rear seat. It was next contended that
the co-accused Kundan Singh has already been enlarged on bail by the
Sessions Judge concerned. The other accused Vikas Kumar Singh has also
been enlarged on bail. It was further contended that the applicant is in jail for
the last about one year and is innocent.

There does not appear to be any reasonable ground to believe that the
applicant will tamper with the witnesses or abscond, if released on bail.

Keeping in view the nature of the offence, evidence, complicity of the
accused, the severity of the punishment and submissions of the learned
counsel for the applicant and the learned AGA, I am of the view that the
applicant has made out a case for bail.

Let the applicant Dinesh Pratap Singh alias Pappu alias D.P. Singh involved
in Crime No. 440 of 2009, under sections 392 and 411 IPC, P.S. Kursi,
District Barabanki be released on bail on his furnishing a personal bond and
two sureties each in the like amount to the satisfaction of the Chief Judicial
Magistrate concerned.
