Heard learned counsel for the parties.
The contention of the learned counsel for the petitioner is that in spite of
evidence adduced to the effect that no constructions were in existence at the
time of the purchase, ignoring the same, the market value of the property has
been determined by treating that the land had commercial constructions in the
shape of six shops.
Learned Standing counsel prays for and is allowed six weeks’ time to file
counter affidavit. Two weeks’ thereafter are allowed to the petitioner for filing
rejoinder affidavit.
Learned Standing counsel in the counter affidavit shall enclose the copy of the
inspection report dated 1.5.2006.
List thereafter.
Until further orders of this Court, the operation of the impugned order dated
08.05.2008 and the appellate order dated 17.06.2010 shall remain stayed
provided the petitioner deposits half of the deficient stamp duty so determined
within a period of one month from today. Any amount of stamp duty already
deposited by the petitioner shall be given adjustment.
In the event of default in depositing the deficient stamp duty within the time
stipulated, the stay order shall automatically come to an end.
