JUDGMENT

1. RULE.

Shri Niraj Soni, learned AGP waives service of notice of rule on
behalf of the opponents.

2. The
present application under Section 5 of the Limitation Act has been
preferred by the applicant-original petitioner to condone the delay
of 159/162 days caused in preferring the Miscellaneous Civil
Application in Special Civil Application No. 2715/2009.

3. Having
heard the learned advocates appearing on behalf of the respective
parties, the delay caused in preferring the Miscellaneous Civil
Application is hereby condoned.

4. With
this, the present application is allowed. Rule is made absolute
accordingly.
