Heard
learned advocates appearing for the parties.
By
an order dated 24.12.2002, while issuing rule returnable on 22nd
January, 2003, proceedings of the suit were ordered to remain stayed
on condition that the petitioner deposits the amount of Rs.2500/-
towards probable cost of the respondent.
However,
considering the facts and circumstances of the case and submissions
made by learned advocates appearing for the parties and Special Civil
Suit No.6 of 1989 is pending in the Court of learned Civil Judge at
Himmatnagar and, therefore, the same may be decided as expeditiously
as possible and preferably within six months from the receipt of the
order of this Court.
With
the aforesaid, this petition under Article 227 of the Constitution of
India is disposed of with no order as to costs. Rule discharged.
