Background
1. The Applicant filed an RTI application dt.4.2.09 with the CPIO, BSNL,
Azamgarh. He requested for information against 10 points about his
telephone connection and his bill for 25.9.07. The CPIO replied on 28.2.09
furnishing point wise information. Not satisfied with the information, the
Applicant filed an appeal dt.30.3.09 with the Appellate Authority. On not
receiving any reply, he filed a second appeal dt.2.6.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 13, 2009.
3. Mr.Jawahar Lal, DGM and Mr.Ram Nayan Ram, Sr.ToA represented the Public
Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that the application in respect of the landline
connection is not available since the relevant file which is more than 11 years
old is not traceable. He stated that several files got misplaced due to shifting
of the office . With regard to the ‘Lo Karlo Bath’ connection, the application
signed by the Appellant himself has already been furnished to him .
6. The Commission holds that all available information has been provided to the
Appellant except against point 4 and directs the CPIO to provide information
against point 4 stating that the GM is the competent authority to waive the
amount charged due to excess metering, to the Appellant , by 10.9.09.
7. The appeal is accordingly disposed of.
