Prayer: Original Application No.8085 of 1999 was filed before the Tamil Nadu Administrative Tribunal, Madras Bench to promote the petitioner to the post of Forest Ranger without reference to the Charge Sheet Dated 07.03.1996 in Proceedings Na.Ka.No.E1/14525/95 with all monetary and service benefits.

ORDER

Original Application No.8085 of 1999 was filed before the Tamil Nadu Administrative Tribunal, Madras Bench to promote the petitioner to the post of Forest Ranger without reference to the Charge Sheet Dated 07.03.1996 in Proceedings Na.Ka.No.E1/14525/95 with all monetary and service benefits. Since the Tamil Nadu Administrative Tribunal was abolished, the O.A. was transferred and numbered as Writ petition.

2. The petitioner seeks promotion from the post of Forester to Forest Ranger as the claim was not considered by the respondents stating that the Departmental Proceedings are pending.

3. The learned counsel for the petitioner fairly states that the inordinate delay should not stand in the way of such benefit and relies on the decision of the Apex Court in Chamanlal Goyal case reported in (1995) 2 SCC 570. He further states that the petitioner’s claim to be considered in the light of the above said decision.

4. Heard Mr. Sathish, learned Government Advocate Forest.

5. At this point of time, if the grievance of the petitioner still subsists, the petitioner is at liberty to make further representation to the first respondent for redressing his grievance. As and when such representation is made, the first respondent shall consider and dispose of the same on merits within a reasonable period of time from the date of such representation along with a copy of this order. This Writ Petition is disposed of accordingly. No costs.
