: The petitioner is an accused in the case registered under
Sections 379 and 411 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submitted
that the petitioner has been falsely implicated in this case; he was
intending to purchase the motorcycle and he was on test drive; he had
never any knowledge that the motorcycle, to be sold to him, is a stolen
motorcycle; learned counsel for the petitioner submitted that the
petitioner has got no criminal antecedent; he is in custody since June,
2010; he is a local permanent resident and there is no chance of his
absconding.
Learned A.P.P. opposed the petitioner’s prayer for bail, but has
not disputed the other contentions of learned counsel for the petitioner.
Regard being had to the facts and circumstances of the case, the
petitioner, above named, is directed to be released on bail on furnishing
bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of
the like amount, each, to the satisfaction of learned Chief Judicial
Magistrate, Garhwa in connection with Garhwa P.S. Case No.170 of
2010, corresponding to G.R. No.648 of 2010.
