                                         JUDGMENT

By Ext.P4 judgment this Court directed the respondent bank to

consider the application of the petitioner. Learned counsel for the petitioner

submits that the petitioner had already submitted Ext.P5 representation

before the respondent, but that was not considered by the respondent bank.

Learned counsel for the respondent bank submits that the petitioner has to

remit 10% of the outstanding amount for getting the benefit under the

scheme and a letter pointing out the above fact was also issued to the

petitioner.

2. Considering the facts and circumstances of the case, the writ

petition is disposed of directing the petitioner to remit 10% of the

outstanding amount within one month from today. If the petitioner remits

the amount as ordered by this court, the respondent bank is directed to

consider Ext.P5 representation and pass appropriate orders thereon as early

as possible, at any rate within 30 days from the date of remittance of the

amount. If the petitioner fails to remit the amount within the stipulated time,

the respondent bank can proceed against the petitioner as per law.
