This
writ petition has been preferred under the caption “Public
Interest Litigation” by three persons from whom, 1st
petitioner is an elected member of the Gujarat Secondary and Higher
Secondary Education Board [“Board” for short].

The
main grievance is that the 1st respondent-State of
Gujarat, without having authority has increased strength of students
of 9th standard from 35 to 60 or 65, which, according to
them, is neither rational nor in the interest of the students.

From
the prayers made in the present case, it will be evident that though
prayer has been made to set aside the resolution passed by the 1st
respondent increasing number of the students in the secondary and
higher secondary schools in the Gujarat State, but no specific prayer
has been made as to which resolution is to be quashed. This apart, as
we find that one of the petitioners is an elected member of the
Gujarat Secondary and Higher Secondary Education Board, there is a
policy decision as to what will be the strength of the students of
9th to 12th standards and it has nothing to do
with public interest, we are not inclined to entertain the petition.
It is accordingly dismissed with cost of Rs. 10,000/- [Rupees Ten
Thousand only] to be paid by the petitioners in favour of Gujarat
State Legal Services Authority, High Court of Gujarat.
