Heard Mr. A. K. Singh, learned counsel for the applicant, learned AGA for
the State and perused the record.
It has been argued by Mr. Singh that on the date of alleged forgery to which
the applicant is said to be a party, he was not on the post alleged by O.P. No.
2 and therefore, there could be no occasion for him to make any alteration,
interpolation or correction in the concerned record. It was further argued that
the I.O. has not collected any evidence that in the original record the forgery
was committed under the handwriting of the applicant. Therefore, there was
no evidence against the applicant to file a charge sheet and it has wrongly
been filed.
Issue notice to respondent no. 2.
Both the respondents may file counter affidavit within two weeks. Rejoinder
affidavit, if any, may be filed within one week thereafter.
List thereafter.
Till then the proceedings of Criminal Case No. 3789 of 2009, State Vs.
Rajendra and others, pending in the court of III A.C.J.M., Varanasi, shall
remain stayed.
