ORAL ORDER
This Court has issued
notice on 26.3.2010 making the same returnable on 31.3.2010. The
Court has passed an order granting leave to the petitioner to join
Additional Mamlatdar, Rajkot as party respondent. All the three
respondents are duly served. Neither any one of them has appeared
before the Court nor any instruction they have passed on to the
learned Assistant Government Pleader. The learned Assistant
Government Pleader has expressed her inability in absence of any
instruction from the respondents. The Court has specifically
directed on 26.3.2010 while joining Additional Mamlatdar, Rajkot as
a party to produce report of the Mamlatdar which was submitted
before the Collector on the basis of which the Collector has passed
the impugned order. The Additional Mamlatdar’s order dated 7.11.2009
is still not produced on record.
Mr. M. B. Gandhi, learned
advocate appearing for the petitioner in both these petitions has
therefore requested the Court to grant interim relief as prayed for.
The Court would have granted interim relief after perusing the
report of the Mamlatdar, if produced.
Considering the facts of
the case the matter is adjourned to 7.4.2010 with a specific
direction to the Additional Mamlatdar, Rajkot to remain personally
present alongwith relevant file of both these petitions.
