ORDER

Heard
learned advocates appearing on behalf of respective parties.

Rule
is issued by this Court on 15th April 2009 and ad-interim
relief was granted in terms of paragraph 4(A) on condition that
applicant appellant shall have to deposit entire decretal amount
together with cost and interest before trial Court concerned on or
before returnable date. The appeal is admitted by this Court on 15th
April 2009.

Learned
advocate Mr. Vyas submitted that amount as per directions issued by
this Court is deposited by applicant appellant before trial Court
concerned and thereafter, one Civil Application No.423 of 2010 is
filed for opponent with a prayer to disburse some amount in favour of
opponent.

After
considering submissions made by both learned advocates, this Court
has passed an order on 27th January 2010 where it was
directed to trial Court concerned to pay Rs.10 lakhs by account payee
cheque in name of Shah Paper Mills Limited present opponent,
after proper verification. Rest of amount is invested in any
Nationalised Bank with cumulative interest.

Therefore,
rule is made absolute in terms of order dated 27th January
2010 passed in Civil Application No.423 of 2010.
