3 03.11.2011 Heard learned counsel for the petitioner, State and

learned counsel appearing for O.P. no.2.

Petitioner is one of the named accused who is husband

of the complainant with allegation of demand of dowry, torture

etc.

Submission from the Bar is that the couple is ready

and willing to resume and continue matrimonial relationship

giving full respect to each other and other family members.

Considering the facts and circumstances of the case in

the event of filing an application of compromise and or

individual application on behalf of the petitioner stating such

intention, let the above named petitioner in the event of arrest or

surrender in the court below within a period of four weeks, be

enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten

thousand) with two sureties of like amount each to the satisfaction

of S.D.J.M, Serghati at Gaya in complaint case no. 692/010,

subject to the conditions laid down under section 438(2) Cr.P.C.

and additional condition to attend the court regularly till disposal

of the case. Further in the event of filing joint application of

compromise or in case of individual application on behalf of the

petitioner on receiving positive response from the complainant,

the court below shall permit the couple to reside in the company

of each other at their place of choice who will report personally

on the date fixed for the purpose and on being satisfied by their

conduct the court below shall pass appropriate order in accordance

with law.
