COMMON
ORAL ORDER

With
the indulgence of learned advocate Mr.M.D. Pandya for the respondent
and in peculiar facts of this case, the parties have settled the
matter outside the Court, whereby the persons who were discharging
technical duties will be assigned technical duties as far as possible
so as to utilise their experience of discharging technical duties to
utilise their capacity maximum.

Learned
advocate Mr.Mishra places on record consent letter along with Office
Order dated 26th September 2011 from the Office of the
Dakshin Gujarat Vij Co. Limited. The same are taken on record. So
far as staff which was discharging non technical duties, namely,
Stenographer, are placed as senior assistant.

It
goes without saying that both the parties will honour the
understanding arrived at between them. In light of the fact that the
matter is settled in view of the peculiar facts, outside the Court,
it is clarified that the said understanding is not to be cited as a
precedent in any other matter.

Liberty
is reserved in favour of the parties.

2. Both
the Special Civil Applications are disposed of accordingly.
