The subject matter of challenge in the instant writ petition

is order dated 24.2.2007 (Annexure P-5) passed by the Market

Committee, Jagadhari-respondent no.4. It is undisputed position that

against the aforementioned order, a remedy of appeal under Section
CWP No. 3302 of 2008 2

40 of the Punjab Agriculture Marketing Produce Act, 1961

(hereinafter referred to as `the Act’) is available and the petitioner

has not availed of that remedy. In fact, even the remedy of revision

has also been provided under Section 42 of the Act.

Accordingly, the petitioner is relegated to the statutory

remedy of appeal and revision.

Writ petition stands disposed of accordingly.
