                                  JUDGMENT

The petitioner retired as a Vehicle Supervisor from the Palakkad

Depot of the Corporation. He seeks for a direction to disburse the DCRG

and Commuted Value of Pension, in the light of the fact that the marriage of

the daughter is proposed to be held on 30.6.2010. Ext.P3 is the copy of the

invitation letter of the marriage.

2. Heard learned Standing Counsel for the Corporation.

3. It is submitted by the learned counsel for the petitioner that the

petitioner had to raise funds by borrowing from various friends and relatives

for the purpose of the marriage and therefore he will have to repay the same.

In W.A. No.289/2001 this Court framed various guidelines with regard to

the payment of retirement benefits to the retirees of the Corporation. In

clause 5 of the guidelines, it is mentioned that the retirement benefits would

be disbursed strictly on the basis of the date of retirement unless otherwise

ordered by this Court. Herein, the petitioner submits that there is a genuine

reason for overlooking the priority, viz. the marriage of his daughter.

4. The petitioner will produce copies of the invitation letter and

wpc 20262/2010 2

other details regarding the conduct of marriage and after conducting due

enquiries in the matter, admissible amounts will be disbursed by the

respondent within two months from the date of receipt of a copy of this

judgment.

The writ petition is disposed of as above. No costs.
