2. 08.12.2010. Heard learned counsel for the petitioner

and the State.

2. Petitioner is an applicant for

appointment a PDS dealer in Chandi Panchayat of

Purnea Block within Sub-division and District of

Purnea. The case for appointment as PDS dealer in

several Block of Purnea District was considered by

District Magistrate on 8.3.2008 which is evident

from Annexure-5. Appointment of a PDS dealer in

the Chandi Panchayat could not recommended as

scheduled caste candidate was not available for

being appointed as a PDS dealer against reserved

scheduled caste vacancy. PDS dealer(s) in other

categories for which the candidates were available

was recommended. It is submitted that in case

scheduled caste candidate is not available in Chandi

Panchayat, petitioner’s candidature could have been

considered as he belongs to extremely backward

class.

3. Having heard counsel for the parties, I

direct the Collector, Purnea to consider the request

of the petitioner for appointment as PDS dealer for

Chandi Panchayat against scheduled castes vacancy,

as early as possible, in any case within three months

from the date of receipt/production of a copy of this

order before the District Magistrate, Purnea.
