02/ 02.11.2010 Heard learned counsel for the petitioner and learned counsel for

the State and its authorities.

This writ petition is directed against order dated 29.10.2007

(Annexure-3) by which Sub-Divisional Officer, Uda, Kishanganj,

Madhepura cancelled Fair Price Shop Licence No.02 of 1998 of the

petitioner granted under the provision of the Bihar Trade Articles (Licences

Unification) Order, 1984. Against such order, an appeal is provided under

Clause 28 of the Bihar Trade Articles (Licences Unification) Order, 1984 as

well as under Clause 15 of the Government of Bihar, Food Supply &

Commerce Department, Public Distribution System (Control) Order, 2001.

In the said circumstances, learned counsel for the petitioner seeks

permission to withdraw this writ petition in order to file an appeal under the

provision of law before the appropriate authority. Accordingly, this writ

petition is disposed of as withdrawn with the aforesaid liberty.
