Heard learned counsel for the petitioner and the learned standing counsel
appearing for the State-respondents.
Learned standing counsel appearing for the State-respondents prays for and is
granted one month’s time to file counter affidavit. Petitioner shall have three
weeks thereafter for filing rejoinder affidavit.
List after the expiry of the aforesaid period.
Learned counsel for the petitioner urged that the petitioner is due to retire in
the year 2012 and as per government policy a person, who is due to retire
within two years should not be transferred. He has further urged that along
with the petitioner twenty four other persons were promoted on the post of
Assistant Engineer and twenty three persons have been detained at the same
place of posting where they are working whereas the petitioner and one other
person have been transferred.
In this view of the matter, since the petitioner is due to retire in the year 2012,
he is entitled for interim relief.
Until further order of this Court the petitioner shall continue as Assistant
Engineer in District Varanasi and shall be paid salary.
