failing which this application as against O.P. No.2 shall stand

rejected without any further reference to the Bench.

Till appearance of O.P. No.2, further proceeding

before the Judicial Magistrate, Sri Rakesh Kumar, Patnacity

in C.A.No.126/2009 shall remain stayed in connection with

above named petitioner.
