The petitioner, who is the registered owner of a stage

carriage bearing Registration No.KL-03/H-640, has filed this

Writ Petition challenging Ext.P2 communication issued by the

Regional Transport Officer, Muvattupuzha. As per Ext.P2, the

petitioner has been informed that the 2nd respondent has filed

objection stating that his vehicle bearing Registration No.

KL-03/H-640 was financed by them while it was under the

ownership of one Sri.Girish Kumar. Since they have initiated

legal proceedings against him for defaulting repayment of the

loan, it has been requested by the 2nd respondent that no

correction in the Registration Certificate may be made. As per

Ext.P2, the Regional Transport Officer has directed the

petitioner to appear for a personal hearing before the said

authority within a period of seven days of receipt of the said

communication.

2. I do not find any reason to interfere with the

proceedings initiated as per Ext.P2. If the petitioner has any

W.P.(C) No.13414/2010 2

objection or explanation to offer, he may do so before the

Regional Transport Officer availing the opportunity that has

been extended to him in Ext.P2. At present, it is sufficient that

the Regional Transport Officer is directed to consider the

contentions of both the petitioner and the 2nd respondent before

taking a final decision in the matter. Final decision as indicated

above, shall be taken expeditiously and at any rate, within a

period two weeks from the date of receipt of a copy of this

judgment.

The Writ Petition is disposed of as above.
