Heard
learned advocate Mr. Tulsi R. Savani appearing on behalf of
petitioner and learned AGP Mr. Sharma appearing for respondent state
authority.
Petitioner
has made representation having grievance for not considering in post
of ASI from Head Constable. Therefore, representation was made on
14/4/2011. Even though learned advocate Mr.Savani submitted that
while ignoring aforesaid representation made by petitioner a
promotion order has been issued by respondent on 31/5/2011.
If
that be so, let petitioner may make further detailed representation
and point out reasons on what basis petitioner is entitled to be
considered for promotion in post of ASI. If any rules are there let
that rules may be pointed out to other side in representation. Let
petitioner may make detailed representation within a period of
fifteen days from date of receipt of copy of present order. As and
when respondent receives such representation from petitioner, it is
directed to respondent to consider and examine grievance of
petitioner and also examine that why petitioner has not been
considered for promotion to post of ASI and then pass appropriate
reasoned order in accordance with law and service rules within a
period of two months from date of receipt of such representation from
petitioner and communicate decision immediately to petitioner.
In
view of above observations and directions, present petition is
disposed of by this Court without expressing any opinion on merits.
Direct service is permitted.
