                           J U D G M E N T

The prayer sought in this writ petition is to direct the 2nd

respondent to admit the petitioner to a seat in the MBBS Course

in the colleges, which are members of the 2nd respondent

Association. Going by the pleadings, it is seen that the petitioner

responded to the notification issued by the 2nd respondent and her

name was also included in Ext.P5 list. But her name was omitted

in the final list for the reason that the fee and refundable caution

deposit that was payable was not remitted by the petitioner

before 5.00 p.m on 11/9/2010. On the other hand, it is submitted

that the fee was received by the respondents only on 13/9/2010

by post. It was therefore that the petitioner’s name was not

included in the final list.

2. Although according to the petitioner, it was because of

the intervening holidays that the delay has happened, fact

remains that out of 331 students that were eligible, 253 students

have remitted the fee within the time specified in Ext.P3

Prospectus. In that view of the matter, I am not persuaded to

direct the respondents to admit the petitioner as sought for.

Writ petition fails and is dismissed.
