ORAL
COMMON ORDER

(Per
: HONOURABLE MR.JUSTICE JAYANT PATEL)

1 Rule.

Mr. A.V. Prajapati, learned Advocate appears for all the
respondents – claimants and waives service of notice of rule and
states that the original claimants have no objection if the delay is
condoned. However, he has prayed that, the First Appeals be listed
for hearing since for the very village-Mansa, this Court has already
taken the view and he places reliance on the same.

2

The applications are for condonation of delay of 440 days in
preferring the First Appeals against the judgment and award passed
by the Tribunal, which are impugned in the concerned First Appeal.

3 Hence,
considering the facts and circumstances and in view of the ground
stated in the application for condonation of delay and more
particularly in view of the declaration made on behalf of the
original claimants, the delay deserves to be condoned, therefore,
condoned. All the Applications are allowed to the aforesaid extent.
Rule is made absolute.

4 Registry
is directed to list First Appeal (St) Nos. 1006 to 1050 of 2011 for
final disposal on 28.6.2011.
