Heard learned counsel for the petitioner and learned Standing Counsel.
With the consent of learned counsel for the parties, the writ petition is
being disposed of finally at the admission stage itself.
Learned Counsel for the petitioner submits that petitioner’s father,
namely, Late Hari Ram, while working as Constable, died on 21.8.2007.
He immediately moved an application for compassionate appointment
under the Uttar Pradesh Recruitment of Dependents of Government
Servant Dying-in-Harness Rules, 1974 [hereinafter referred to as ‘Rules
1974’ ]. Thereafter, the opposite party No.3-Senior Superintendent of
Police, Faizabad demanded all necessary documents by the letter dated
13.12.2007, which was furnished to the opposite party No.3 in the
month of June, 2008 but till date no decision has been taken by him and
as such, he preferred the instant writ petition.
Learned counsel for the petitioner submits that interest of justice would
suffice, if the opposite party no.3 is directed to consider the claim of the
petitioner for appointment under Rules 1974 on compassionate ground,
expeditiously, to which learned Standing Counsel has no objection.
Considering the peculiar facts and circumstances of the case, the writ
petition is disposed of finally with a direction to the opposite party No.3
to consider the claim of the petitioner for appointment under Rules 1974
on compassionate ground, expeditiously, say, by 30th April, 2010 and
communicate the decision to the petitioner forthwith.
